Judicial Review of Town Green Decision to be launched by Radley Parish Council

Following its meeting yesterday evening (28th February) Radley Parish Council issued the following statement


Radley Parish Council is pleased to see the recent press statement by RWE npower but, in line with its earlier resolution and as a result of the recent public consultation, which showed overwhelming support for saving the Radley Lakes from being filled by RWE npower, Radley Parish Council has today decided to proceed with the Judicial Review of Oxfordshire County Council’s decision not to register land around Thrupp and Bullfield Lakes as a town green.

This action follows a recent consultation of the residents of Radley, the result of which was that an overwhelming 88% supported saving the lakes from destruction and 80% supported proceeding with the judicial review. An earlier decision by the Council had committed it to carrying out the action if more than 50% voted in favour.

The recent statement by RWE npower that Thrupp Lake is safe from infilling in the short term was considered to offer insufficient assurance that npower was doing enough to ensure the preservation of the lake in the long term. The Parish Council did however indicate that it would like to reopen a dialogue with npower to discuss the future of the lakes. In the meantime, the starting of judicial review proceedings was considered necessary because of the requirement, imposed by the courts, for such action to be taken promptly.

Radley Parish Council would have much preferred the action to have been led by Abingdon Town Council on the basis of its legal standing in relation to the Town Green application, and because it is suspected that the majority of lakes’ users come from Abingdon. Strong representations were indeed made to the Town Council to this effect. After considering the request, the Town Council did offer its support for the legal action, but stopped short at becoming directly involved, thus leaving Radley Parish Council to undertake the judicial review on its own. The Vale of White Horse District Council, Oxford City Council and neighbouring Kennington Parish Council have also all declared their support for the action.
