The
planning application by RWE Npower to fill Lake E
with pulverised fuel ash (PFA) has now been referred
to the Secretary of State for Communities and Local
Government, Ruth Kelly for a decision on its determination.

Because
the resolution by Oxfordshire County Council to grant
permission is contrary to the local development plan,
the application has to be referred to the Secretary
of State. She now has until 19 September to decide whether
to call the application in for a planning enquiry, or
allow Oxfordshire County Council to grant permission.
The decision will be based upon a recommendation by
the Government Office for the SE (GOSE). If however
the Secretary of State needs more time to come to a
decision, then she can issue a Holding Order which will
prevent Oxfordshire County Council from granting permission
in the meantime.
